I acknowledge that using the facilities at Training Loft 714 may involve risk of injury to me or my guests, whether caused by me or someone else. Specific risks vary from one activity to another and the risks range from minor injuries to major injuries to death. In consideration of participation of activities offered by the Center, I understand and voluntarily accept this risk of injury and agree that Training Loft 714 (here forth referred to as “the Center”), its managers, employees, volunteers and independent contractors will not be liable for any injury, including, without limitation, personal, bodily, or mental injury, pathogen or any other related illnesses, any loss or theft of personal property, any economic loss or damage to me, my spouse, my minor children or any unborn child, my guests or relatives resulting from the active or passive negligence of the Center or anyone on the Center’s behalf or anyone using the Centers facilities whether related to exercise or not. My assumption of risk includes, without limitation the use of any exercise equipment (mechanical or otherwise) bathrooms, sidewalks, parking lot, stairs, lobby area, or any equipment in the Training Center. This waiver and release of liability includes, without limitation, injuries which may occur as a result of (a) my use of any exercise equipment or facilities which may malfunction or break, (b) the Center’s improper maintenance of any equipment or facilities, (c) the Centers negligent instruction or supervision, including personal training, (d) the Centers inadequate security or staffing, and (e) slipping and/or falling while on the facility or any portion of the premises for any reason including the Centers negligent inspection or maintenance of its facility. By execution of this agreement, I hereby agree to indemnify and hold harmless the Center and our affiliates, employees, agents, representatives, successors and assigns from any loss, liability, damage or cost I may incur due to my presence at the Center. I further agree that the forgoing release, waiver and indemnity agreement is intended to be as broad and inclusive as permitted by law in the state of California and that if any portion thereof is held invalid, it is agreed that the remaining provisions shall continue in full legal force and effect.

You acknowledge that you have read the waiver and release and fully understand that it is a release of liability, and express assumption of risk and indemnity agreement. You are aware and agree that by executing this waiver and release, you are giving up your right to bring legal action or assert a claim against Training Loft 714 it’s negligence, or for any defective product on its premises. You have read and voluntarily signed the waiver and release and further agree that no oral representations, statements, or inducement apart from the forgoing written agreement have been made
